13 3 13 High Court Decision


High Court Decision

Clearly the UMCQ is disappointed with the decision of the High Court, and see it as another nail in the coffin of the ‘no-longer’ right to see the evidence against you. We believe this decision goes against principals of law dating back to the Magna-Carta in 1215.

38. No bailiff for the future shall, upon his own unsupported complaint, put anyone to his "law", without credible witnesses brought for this purposes.

This from the Magna-Carta states ...without credible witnesses... If you have no knowledge of the witness or evidence, how can you prove or disprove it to be credible or not? The Police no longer have to prove their case “Beyond Reasonable Doubt”. This removes one of the fundamental principals of our Legal Justice System; with every step taken we are on a steeper and steeper slope to complete loss of freedom. When the big banks can be deemed too big to prosecute as in just recently with HSBC paying a fine equivalent to only a couple of months profit for Laundering Drug Money, Dealing with the Enemy (Iran) breaching embargos, we the people will be jailed for minor breaches of unjust laws, yet NOONE from HSBC was jailed for Trillions of Dollars of Fraud and Illegal dealings.

There has over time been an erosion of the right to examine the evidence put against you. Without the ability to test the evidence brought against you or to test the “credibility” of the witness, will lead to a travesty if not today, sometime in the future, of this there can be no doubt. The increased use of Secret Evidence (Criminal Intelligence) has been widely criticised. The UMCQ will be meeting to discuss the outcome of this decision and the possible legal channels open to us. Although the Police propaganda machine has done a good job of selling the Criminal Organisations Act as “Anti-Bikie Laws”, remember there is nothing in these laws that say Motorcycle club, Bikie or anything similar. These laws can be used against any group the police feel free to use them against.

The NRL, AFL, Australian Institute of Sport, these sporting bodies can have these laws used against them. The Catholic Church, the Anglican Church, the Exclusive Brethren can all have these laws used against them.

These laws are for all Australians, except as in the Media reforms proposed, the Government and Police.

I would like to say ride free etc, but I feel today that the time will come where that will no longer be possible. I always knew this fight would go on forever, but too many people within the Biking community thought that after the SA Finks win it would be a lay-down Misere. Well for those that have not been contributing to the fight, are you happy with the result?

Lest we Forget


It is with iron clad assurance that I can state there are one ‘collective’ group of organisations that will not fit in to Catholic Archbishop Pell’s “It wasn’t just the Catholic Church that hoped (an abusive priest) would amend their conduct and give them a home somewhere else”... and that is, Three-piece Patched Motorcycle Clubs. This I can state with absolute knowledge, that this type of behaviour would not be tolerated by any Patch Club.
Unlike the Catholic Church, and unfortunately the Archbishop Pell is correct as we know the Anglican Church and the Exclusive Brethren have all  conspired to cover up Paedophilia within their Churches, and there can be no doubt that other organisations have done the same. The open letter from Senior Detective Peter Fox to Premier Barry O’Farrell clearly makes the allegation, “I can testify from my own experience that the church covers up, silences victims, hinders police investigations, alerts offenders, destroys evidence and moves priests to protect the good name of the church,” it is similar claims against Patched Motorcycle Clubs (not Paedophilia, but silencing witnesses, hindering police investigations, etc;) that sees legislation brought in that has so far proven to be unconstitutional, to have them declared Criminal Organisations. As yet there has not been a politician with the testicular fortitude to suggest that the Catholic Church is, under the definition of Criminal Organisation within the various acts, is in fact a criminal organisation and should be treated the same way as Motorcycle Clubs. 10 Court may make a declaration

(1) The court may make a declaration that the respondent is a criminal organisation if the court is satisfied that—

(a) the respondent is an organisation; and

(b) members of the organisation associate for the purpose of engaging in, or  conspiring to engage in, serious criminal activity; and

(c) the organisation is an unacceptable risk to the safety, welfare or order of the community.

(2) In considering whether or not to make a declaration, the court must have regard to—

(a) the following information before the court—

(i) information suggesting a link exists between the organisation and serious criminal activity;

(ii) any conviction for current or former members of the organisation;

(iii) information suggesting current or former members of the organisation have been, or are, involved in serious criminal activity, whether directly or

indirectly and whether or not the involvement resulted in convictions;

(iv) information suggesting members of an interstate or overseas chapter or branch of the organisation associate for the purpose of engaging in, or

conspiring to engage in, serious criminal activity;

 There is in-fact more evidence to support conviction of the Catholic Church under these unconstitutional laws than any Motorcycle club. Did our solders’ fight and die to allow Churches to control our legal & political processes? Did our solders’ fight and die to see our freedoms taken by our own politicians, the very freedoms that they gave (and continue to give) their lives fighting to protect, for other countries citizens?

Because these Anti-freedom of Association laws know no State or national borders, I am not going to limit my rants to things happening in Sunny Queensland.

On the First of June the Age newspaper from Melbourne reported on a cop accused of leaking information to a strip club owner, yeah interesting enough, but the thing in the article that gets my goat is the mentioned rumour that is just glossed over.

“...But Mr Trimble also said he hoped his friend or MacDonald could confirm a rumour that licensing officials planned to replace businesses between the Rialto and Flinders Lane to allow the Grollo group to develop retail outlets...”

Now if this rumour is close to the truth, the question needs to be asked is the licensing branch actually engaged in replacing businesses to the benefit of the Grollo group? If so why? Unless there is a states town planning agenda that is ratified the licensing branch should not be working to the gain of big business.

But, aside from that why does the Age newspaper not comment about the prospect that the licensing branch is working for Grollos profit? Is it because mainstream media is just a tool of big business and the Government? When mainstream media starts to report the news with an even handed approach instead of sensationalising the story, (opps forgot that won’t sell papers).
What can be done to stop this one sided reporting? Write them a letter, put a stamp on it. It makes a difference. E-mails can be deleted to easy (I know a letter can be shredded) it is just that when someone goes to the trouble to write a letter and mail it in the old fashion way it now has a bit more impact than it once did.

The same goes to letter writing to Politicians, a subject that I will deal with in another blog.
